1. Introduction

These Terms of Service ("Terms") govern your use of TutorBee's website at www.tutorbee.sg and our tuition matching services. By using this website, you agree to accept all terms and conditions written herein. If you do not agree with any of these Terms, you should not use this website.

Please read these Terms attentively. Your access to and usage of our services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users, visitors, and others who access or use this website.

2. User Eligibility

To use our services, you must meet the following requirements:

  • You must be at least eighteen (18) years of age to enter into this agreement independently.
  • If you are between thirteen (13) and eighteen (18) years old, you must have parental or guardian permission to accept these Terms and use our services.
  • You must be a resident of Singapore or have a valid reason to seek tuition services in Singapore.
  • You must provide accurate and complete information during registration or when submitting requests.
  • You must not have been previously banned or removed from our platform.

3. Description of Services

TutorBee operates a tuition matching platform that connects parents/students ("Clients") with qualified tutors in Singapore. Our services include:

  • Receiving and processing tuition requests from parents/students
  • Matching clients with suitable tutors based on requirements
  • Facilitating introductions between matched parties
  • Providing tutor profiles and credentials for review
  • Processing payments between clients and tutors
  • Arrangements including home tuition, tuition in public places, group tuition, and online tutoring

All visitors, whether registered or not, shall be considered "Users" of our services. Once an individual registers or submits a request, they become a "Member." There are two types of members: "Client" (a parent or student who engages a tutor) and "Tutor" (a person registered to provide tuition services).

TutorBee reserves the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. You acknowledge that TutorBee shall not be liable for any such changes.

4. Account Registration and Security

To become a member, you must be in good standing and not a person who has been previously barred from receiving our services.

Users who register with TutorBee are required to provide accurate, valid, complete, and current information. You agree to update your information should there be any changes. If you provide information that is not accurate or updated, we may terminate your access to our services.

When you create an account, you are the sole authorised user. You shall be responsible for:

  • Maintaining the confidentiality of your password and login credentials
  • All activities that occur under your account
  • Notifying TutorBee immediately of any unauthorised access or security breach

TutorBee shall not be held liable for any loss or damage arising from failure to comply with these security requirements.

5. Rates, Commission, and Payment

All currency references are in Singapore Dollars (SGD). You shall be responsible for payment of all applicable taxes.

Tuition Rates:

Tuition rates listed on our website are guidelines only. The exact price for tuition services may differ depending on client requirements, market conditions, and tutor availability. The final rate shall be confirmed by agreement between both parties via an official confirmation from TutorBee.

Commission:

TutorBee charges a commission to tutors for successful matches. The commission amount will be clearly communicated to tutors before assignment confirmation. Tuition rates agreed upon should not be changed unless clients and tutors mutually agree. TutorBee reserves the right to claim commission based on the original agreed tuition rate.

Payment Terms:

  • Clients shall pay invoices and inform TutorBee within three (3) days of the due date.
  • Clients are responsible for keeping proof of payment transactions.
  • TutorBee may collect tuition fees from clients and subsequently resolve payment to tutors.
  • Clients are liable to pay tuition fees for all attended lessons, regardless of satisfaction level.

Late Payment:

If payment is not made after fourteen (14) days, a payment reminder letter shall be sent. The account may be referred to lawyers for further recovery actions if settlement remains delayed. The debtor shall be liable to pay all costs including administrative, solicitor, and client costs incurred by TutorBee in enforcing payment.

Refunds:

Refunds may be made to the client's bank account in cases of violations due to the tutor's fault or other valid reasons, at TutorBee's discretion.

6. Client-Tutor Relationship

Commitment Period:

The tutoring period is usually stated clearly when we arrange the tuition assignment. If not specified, all parties should be prepared to commit for at least three (3) months.

Replacement and Cancellation:

  • Clients may request a replacement tutor or cancel at any time after the first lesson, but must still pay for attended lessons.
  • There is an agreement to complete a minimum of one (1) lesson upon tutor confirmation.
  • For cancellations before the first lesson has commenced, clients may be liable for administrative fees equivalent to the first lesson fee.
  • Any changes in lesson frequency in the first 4 weeks must be communicated to TutorBee. Commission may be adjusted accordingly.

Lesson Cancellation and Postponement:

  • Clients shall inform TutorBee and the tutor if postponement or cancellation of any lesson is needed.
  • If the tutor is informed less than two (2) hours before the lesson start time, clients shall be liable to pay 50% of one lesson fee for the tutor's lost time and transport costs.
  • This amount shall be paid immediately on the next visit or via bank transfer.
  • Cancellations or postponements shall not affect TutorBee's commission amount.

7. Responsibilities of Clients

As a client using our services, you agree to:

  • Provide accurate information about your tuition requirements
  • Respond promptly to tutor recommendations and communications
  • Treat tutors with respect and professionalism
  • Provide a safe and suitable environment for tuition sessions (for home tuition)
  • Pay for lessons promptly as per the agreed arrangement
  • Give reasonable notice (at least 24 hours, preferably 2 days) for lesson cancellations or rescheduling
  • Verify tutor credentials if you have any concerns
  • Inform TutorBee of any issues or concerns about matched tutors

8. Responsibilities of Tutors

TutorBee expects all tutors to conduct themselves professionally and ethically. As a tutor, you agree to:

  • Provide accurate information about your qualifications, experience, and availability
  • Upload only authentic documents and credentials
  • Respond promptly to tuition assignment offers
  • Be punctual and deliver full tuition sessions
  • Provide at least two (2) days' notice for changes in timing, unless due to sudden illness (medical certificate required)
  • Maintain regular communication with parents to keep them updated on progress
  • Conduct yourself professionally at all times
  • Not engage in any inappropriate behaviour with students or their families
  • Not engage in physical or verbal abuse (including discouragement or scolding)
  • Comply with all applicable laws and regulations in Singapore

9. Termination

TutorBee may, without prior written notice, immediately suspend, terminate, discontinue, and/or limit your account and access to our services for the following reasons:

  • Any breach or violation of these Terms
  • Request from law enforcement or government agencies
  • Unexpected technical or security issues
  • Extended periods of inactivity
  • Engagement in fraudulent or illegal activities
  • Non-payment of associated fees
  • Unethical conduct or poor performance
  • Providing false, inaccurate, or misleading information

Termination may include removal of access to services, deletion of account information, and barring from further use of our platform.

You may terminate your account at any time by submitting a cancellation request to us via email at least 7 days prior to the termination date.

10. Prohibited Activities

Users of our platform must not:

  • Provide false or misleading information
  • Impersonate another person or entity
  • Use our platform for any unlawful purpose
  • Harass, abuse, stalk, threaten, or defame other users
  • Upload malicious software, obscene, or offensive content
  • Attempt to gain unauthorised access to our systems
  • Scrape or collect user data without authorisation
  • Interfere with the proper working of our services
  • Bypass any measures we use to restrict access
  • Reverse engineer, decompile, or create derivative works from our platform
  • Use our platform to promote other businesses without permission
  • Advertise or conduct commercial activities without TutorBee's prior written consent

Violation of these prohibitions may result in immediate termination and may be reported to relevant authorities.

11. Disclaimers

No Guarantee of Results:

TutorBee does not guarantee any improvement in academic grades or performance. While we will try to provide the best match possible, due to varying factors, we cannot guarantee good results. Educational outcomes depend on many factors including the student's effort, aptitude, and the tutor-student relationship.

Tutor Verification:

While we make reasonable efforts to verify tutor credentials, we mostly rely on information submitted by users. We cannot guarantee the accuracy of all information provided by tutors. Parents are encouraged to independently verify credentials where possible.

Service Availability:

Our platform is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee uninterrupted or error-free access. TutorBee shall not assume any responsibility for timeliness, missed lessons, or other issues arising from use of our services.

Website Content:

We make every effort to ensure website content is accurate, but we cannot accept liability for accuracy at any given time. Content may be incorrect or out-of-date and is subject to change without notice.

12. Limitation of Liability

To the maximum extent permitted by Singapore law:

  • TutorBee shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of our services
  • TutorBee shall not be liable for any acts, omissions, or conduct of tutors, parents, or students
  • TutorBee shall not be legally responsible for any disputes, quarrels, conflicts, or crimes that may occur between clients and tutors
  • TutorBee shall not be liable for any payment disputes between tutors and clients
  • TutorBee shall not be liable for any loss of profits, revenue, business, opportunity, goodwill, data, or reputation
  • Our total liability for any claim shall not exceed SGD 100

These limitations apply regardless of whether we have been advised of the possibility of such damages.

13. Indemnification

You agree to defend, indemnify, and hold harmless TutorBee, its directors, officers, employees, agents, and third parties from any costs, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of or inability to use our services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any tuition arrangements you enter into
  • Any content or information you provide to us

14. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of TutorBee or its licensors and is protected by Singapore and international intellectual property laws.

You may not reproduce, distribute, modify, publish, transmit, or create derivative works from any content on our platform without our prior written consent. You may download content for personal use only, provided you maintain all copyright notices.

15. Third-Party Links

Our website may contain links to other websites or services operated by third parties. TutorBee takes no responsibility for and gives no warranties regarding linked sites. We are not liable for the privacy practices or content of such websites.

16. Arbitration and Dispute Resolution

If the parties are unable to resolve any dispute arising out of or concerning these Terms, whether in contract, tort, or otherwise, such dispute shall be resolved by final and binding arbitration in Singapore, conducted by a mutually agreed arbitration service.

The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. The prevailing party shall be entitled to recover its costs and reasonable legal fees.

You agree to arbitrate all disputes and claims regarding these Terms or any conflicts arising as a result of these Terms, including tort claims.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. Subject to the arbitration clause above, any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.

18. Modifications to Terms

TutorBee reserves the right to change or modify these Terms at its sole discretion. It is your responsibility to review these Terms periodically for changes. Your continued use of our services following the posting of any modifications constitutes acceptance of the new Terms.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TutorBee regarding your use of our services. These Terms supersede any prior agreements or understandings. A printed version of this agreement shall be admissible in judicial or administrative proceedings.
